Acceptance of Terms

Welcome to blacklivesmatterachildsvision.com, (hereinafter referred to as “the site”). The Black Lives Matter: A Child’s Vision ("I" or "BLM: A Child’s Vision") provides the site to you as a service subject to the following Terms of Use ("TOU"). Unless explicitly stated otherwise, all features of our site are subject to the TOU. By using the site, you accept the terms below. If you do not accept any of these terms, you are not authorized to use the site. I reserve the right to modify these terms at any time. Your continued use of the site following the posting of any changes to the TOU constitutes your acceptance of the new terms.

Description of Service

Through the site, Black Lives Matter: A Child’s Vision strives to provide users with access to a rich array of art, text and educational resources. I hope you find the site useful. I reserve the right to modify, suspend, or discontinue the site, or any part of it, at any time, for any reason without prior notice to you. You agree that I shall not be liable for any such modification, suspension, or discontinuance.

User Conduct

As a condition of using the site, you agree not to use the site, among other things, to:

  8. transmit or otherwise make available any Content containing any "virus," "worm," "trojan horse," or any other computer code, file, or program designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;

  9. interfere with or disrupt our site or servers or networks connected to our site, or disobey any requirements or policies of networks connected to our sites; or

  10. intentionally or unintentionally violate any applicable local, state, national or international law.

You further agree that this list is not intended to be complete, but merely illustrative. I reserve the right in my sole and final judgment to determine whether certain conduct violates this User Conduct Section.

Indemnity

You agree to indemnify and hold harmless BLM: A Child’s Vision, my affiliates, and partners from and against any claim or demand, including attorneys' fees, made by any third party in connection with:

  1. any Content that you transmit or otherwise make available via the site,

  2. your use of the site,

  3. your connection to the site, or

  4. your violation of the TOU.

Third-Party Content and Services

Because I provide a variety of resources on the site, it is necessary for me to use third parties to contribute Content and offer services. Any Content or services made available by third parties on the site are those of the respective authors and not of BLM: A Child’s Vision. BLM: A Child’s Vision neither endorses nor is responsible for the accuracy, reliability, or correctness of such Content or services.

The terms in the TOU do not apply to any Web sites that are linked from the site ("linked-sites"). These linked-sites will have their own policies and practices that may be different from mine. You understand and agree that BLM: A Child’s Vision is not responsible for the operation of any linked-site, and does not endorse nor is responsible for any Content, services, or advertising on linked-sites. You agree that BLM: A Child’s Vision shall not be held liable for any loss or damage incurred as a result of such Content, services, or advertising.

DISCLAIMER OF WARRANTIES

YOU AGREE THAT:

B.  BLM: A CHILD’S VISION MAKES NO WARRANTY THAT:

THE CONTENT AVAILABLE VIA THE SITE IS ACCURATE, RELIABLE, OR CORRECT;

THE SITE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION;

THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR THE MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH OUR SITE WILL MEET YOUR EXPECTATIONS;

THAT ANY DEFECTS OR ERRORS IN THE SOFTWARE WILL BE CORRECTED; AND

THIS LIMITATION APPLIES WHETHER BLM: A CHILD’S VISION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, OR ANY OTHER BASIS. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, CERTAIN LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.

Intellectual Property

Unless otherwise indicated, the Content displayed on the site is the property of BLM: A Child’s Vision and is protected by copyright, trademark and other laws. Any such Content may be displayed solely for your personal, non-commercial use. You agree not to reproduce, modify, publish, translate, create derivative works from, distribute, display, retransmit, or sell such Content without the prior written permission of the respective owner. BLM: A Child’s Vision and the BLM: A Child’s Vision logo are service marks of BLM: A Child’s Vision. You may not display or use such service marks in any manner without prior written permission from Aisha Scott.

Entire Agreement

The TOU constitutes the entire agreement between you and BLM: A Child’s Vision governing your use of the site and supersedes any prior agreements, if any, between you and BLM: A Child’s Vision relating to any matter dealt with in the TOU. You may also be subject to additional terms that apply when you use links or third-party Content or services.
